Membership Agreement

This is a courtesy translation; in case of any discrepancy, the Turkish version prevails.

This agreement sets out the terms for opening and using a membership account on the geciskontrolavm.com website. You must accept this agreement to become a member; you can also shop without becoming a member.

1. Parties

This agreement is concluded between the Seller, whose details are given below, and the person who opens an account by completing the membership form (the “Member” or “you”).

2. Subject of the agreement

The subject of this agreement is the terms under which you use the services on the website with your membership account, and the rights and obligations of the parties. Orders you place on the website are additionally subject to the Distance Sales Agreement.

3. Creation of membership

• Membership is created when you complete the membership form with accurate and up-to-date information and approve this agreement. Membership is free of charge.
• You must be at least 18 years old to become a member.
• If you become a member on behalf of a company or institution, you represent that you are authorized to act on behalf of that company or institution.
• When your information changes, you must update it in your account.

4. Services provided with membership

• Viewing your orders and their statuses,
• Saving your delivery and billing addresses,
• Listing your favorite products,
• Updating your account information and your commercial message preference,
• Creating a return request for orders where the Start Return button appears in the order details.

5. Account security

You are responsible for keeping your password confidential and not sharing it with others. If you believe your account has been used without your permission, change your password and notify us immediately. If you forget your password, you can use the password reset link on the login page.

6. Member’s obligations

You agree to use the website in compliance with the law and this agreement, and not to engage in any conduct that would disrupt the operation of the website, attempt to access other people’s accounts, or infringe the rights of others. The texts, images and designs on the website may not be copied or used for commercial purposes without the permission of the right holders.

7. Personal data and commercial messages

Information about the personal data processed during your membership is available in the Privacy Notice (KVKK).

Receiving campaign and announcement messages is optional, and approval is given through a separate, not pre-checked box on the membership form; you can become a member without giving approval. You can withdraw your approval at any time on the My account page or via the opt-out link in the messages. Details are available on the Commercial Electronic Message Consent Text page.

Mandatory notifications about your order and your membership (e.g., order, shipping and password reset emails) are not commercial messages and are sent regardless of your approval.

8. Amendments to the agreement

We may update this agreement only for justified reasons, such as changes in legislation or in the services on the website. The current text is published on this page. We will notify you of any changes to your detriment, before they take effect, at the email address registered to your account; if you do not accept them, you may terminate your membership free of charge. Orders you have already placed are subject to the terms in effect on the order date.

9. Termination of membership

You may terminate your membership at any time, free of charge. To do so, simply write to [email protected] from the email address registered to your account.

If we determine that the account is being used in violation of this agreement or of the legislation, we may suspend or close the account after notifying you of the situation and the reasons for it. Closing the account does not affect your rights or our obligations regarding orders you have already placed.

When your account is closed, your personal data is deleted, destroyed or anonymized after the retention periods required by the legislation have expired.

10. Disputes

We kindly ask that you first submit your complaints to us; we will do our best to resolve them. This does not limit your statutory rights of recourse set out below.

For disputes below the monetary threshold announced each year by the Ministry of Trade, you must apply to the consumer arbitration committee at your place of residence or at the place where you carried out the transaction. For disputes above this threshold, you may file a lawsuit with the consumer court, provided that you apply to a mediator before filing; you may also file the lawsuit with the consumer court at your own place of residence. You can also apply to the arbitration committee through the Consumer Information System (TÜBİS) on e-Devlet.

The courts and enforcement offices of Kayseri have jurisdiction over disputes arising from memberships opened for commercial or professional purposes.
